Terms of Service

1. Acceptance of Terms

By accessing and using EventStuffer ("the Platform"), operated by Molnx (molnx.cloud), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Molnx. If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of the updated Terms.

2. Description of Service

EventStuffer is a marketplace platform that connects event planners and organisers ("Clients") with freelance professional event staff including hostesses, DJs, bartenders, brand ambassadors, and servers ("Staff"). Molnx facilitates bookings, escrow payments, and communication between parties but does not directly employ Staff or provide event staffing services. Staff are independent contractors and not employees of Molnx. Molnx is not a party to any agreement between Clients and Staff beyond facilitating the transaction through the Platform.

3. User Accounts

  • You must be at least 18 years old to create an account. Age verification is required upon first access.
  • You are responsible for maintaining the confidentiality and security of your account credentials.
  • You must provide accurate, current, and complete registration information and keep it updated.
  • One natural person may not maintain more than one account. Agency accounts are available for staffing agencies.
  • You are responsible for all activity that occurs under your account, whether authorised by you or not.
  • You must notify us immediately of any unauthorised access to or use of your account.

4. Client Responsibilities

As a Client using EventStuffer, you agree to:

  • Provide accurate and complete event details (date, time, location, duration, service type) when making bookings
  • Treat all Staff with respect, professionalism, and dignity at all times
  • Pay for all services exclusively through the Platform's payment system — off-platform payments are prohibited
  • Not request services outside the scope of the confirmed booking or that violate applicable laws
  • Provide a safe working environment for Staff at the event location
  • Report any issues, safety concerns, or disputes through the Platform's dispute resolution system within 48 hours

5. Staff Responsibilities

As Staff on EventStuffer, you agree to:

  • Maintain an accurate, up-to-date profile including qualifications, skills, photos, and availability
  • Respond to booking requests within 24 hours
  • Arrive on time and provide the agreed-upon services professionally and to the best of your ability
  • Maintain professional conduct at all times during events and in all Platform communications
  • Complete identity verification and any required background checks
  • Use the Platform's safety check-in/check-out system during events
  • Not solicit Clients for off-platform bookings or share direct contact information to circumvent the Platform

6. Payments, Fees, and Escrow

All financial transactions are processed through our escrow payment system:

  • All payments are processed securely through Stripe. Payment card details are never stored on our servers.
  • When a Client books Staff, the full booking amount is held in escrow by Stripe until the event is completed.
  • A platform fee (as displayed at the time of booking) is deducted from each completed transaction.
  • Staff payouts are initiated within 48 hours after the Client confirms booking completion, or automatically 72 hours after the event end time if not disputed.
  • Staff are responsible for their own tax obligations. The Platform provides annual earnings summaries and invoices for record-keeping.
  • Tipping is optional and processed directly through the Platform at a 0% platform fee.

7. Cancellation and Refund Policy

Cancellation refunds are determined by the timing of the cancellation relative to the booked event start time:

  • More than 48 hours before event: Full refund to the Client
  • 24 to 48 hours before event: 50% refund to the Client
  • Less than 24 hours before event: No refund (full amount released to Staff)
  • Staff-initiated cancellation: Full refund to the Client plus priority rebooking assistance. Repeated Staff cancellations may result in account penalties.
  • Pending bookings (not yet accepted): Full refund, no charge to either party
  • Disputed bookings: Funds remain in escrow pending resolution through the dispute resolution process
  • Optional cancellation insurance (5% of booking total, purchased at checkout) upgrades the less-than-24-hours tier to a 50% refund

8. Prohibited Conduct

The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban:

  • Harassment, discrimination, threats, or abusive behaviour toward any user
  • Fraud, misrepresentation of identity, qualifications, or services
  • Solicitation of services outside the Platform to avoid fees
  • Uploading inappropriate, explicit, or illegal content (including in photo galleries and portfolio items)
  • Creating fake reviews or manipulating ratings
  • Sharing another user's personal information without consent
  • Using automated tools, bots, or scrapers to access the Platform
  • Any activity that violates applicable local, national, or international laws

9. Photo and Content Guidelines

Users who upload photos, portfolio items, or other content to the Platform must ensure that:

  • All photos are of the actual person represented in the profile and are recent (within the last 12 months)
  • Content does not infringe on any third party's intellectual property, privacy, or publicity rights
  • Photos of events may only be uploaded with the explicit consent of all identifiable individuals
  • Content is appropriate for a professional staffing context and does not contain explicit or offensive material
  • Molnx reserves the right to remove any content that violates these guidelines without notice

10. Reviews and Ratings

Reviews and ratings are an important part of the EventStuffer community:

  • Both Clients and Staff may leave reviews within 14 days of a completed booking
  • Reviews must be honest, fair, and based on actual experience during the booking
  • Reviews may not contain personal attacks, discriminatory language, or irrelevant content
  • Staff may respond publicly to reviews. Disputed reviews may be flagged for moderation.
  • Molnx reserves the right to remove reviews that violate these guidelines or that are determined to be fraudulent

11. Intellectual Property

All content on EventStuffer, including but not limited to logos, trademarks, text, designs, software, and compilations, is the property of Molnx or its licensors and is protected by intellectual property laws. Users retain ownership of their uploaded content (photos, portfolio items, profile text) but grant Molnx a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute such content solely for the purpose of operating and promoting the Platform.

12. Limitation of Liability

EventStuffer operates as a marketplace platform. To the maximum extent permitted by applicable law: (a) Molnx is not liable for the acts, omissions, quality of services, or conduct of any Client or Staff member; (b) Molnx does not guarantee the accuracy of user profiles, reviews, or any user-generated content; (c) Molnx's total liability for any claim arising from your use of the Platform shall not exceed the total fees paid by you to the Platform in the 12 months preceding the claim; (d) Molnx shall not be liable for indirect, incidental, special, consequential, or punitive damages.

13. Dispute Resolution

If a dispute arises between a Client and Staff member, both parties should first attempt to resolve the issue directly through the Platform's messaging system. If resolution is not reached, either party may file a formal dispute through the Platform within 48 hours of the event. Molnx's support team will review all available evidence (messages, booking details, check-in records) and issue a binding decision within 5 business days. During the dispute period, escrowed funds are held pending resolution.

14. Safety and Emergency Procedures

EventStuffer provides safety features including check-in/check-out tracking, emergency contacts, and overdue checkout alerts. Staff are required to use the safety check-in system when arriving at and departing from event locations. If a Staff member's check-out is overdue by 30 minutes or more, the Platform automatically notifies their designated emergency contact. In case of any emergency, users should contact local emergency services immediately and then report the incident through the Platform.

15. Agency Accounts

Agencies may create an agency account to manage a roster of Staff members. Agencies are responsible for the accuracy of their rostered Staff profiles and for ensuring all Staff comply with these Terms. Agencies may negotiate commission arrangements with their Staff independently, but all bookings must be processed through the Platform. Agency accounts require separate acceptance of these Terms.

16. Subscription Plans

EventStuffer offers optional subscription plans (Basic, Pro, Premium) that provide additional features such as enhanced visibility, priority placement, and lower platform fees. Subscriptions are billed monthly through Stripe and renew automatically. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

17. API Access

Enterprise subscribers and administrators may access the EventStuffer API using API keys. API access is subject to rate limiting (1,000 requests per hour per key). API keys must be kept confidential and may not be shared. Molnx reserves the right to revoke API access at any time for misuse or violation of these Terms. 18. Indemnification

You agree to indemnify, defend, and hold harmless Molnx, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you upload to the Platform.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. Any disputes arising from these Terms or your use of the Platform that cannot be resolved through the dispute resolution process described in Section 13 shall be subject to the exclusive jurisdiction of the courts of Germany. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Changes to Terms and Contact

Molnx reserves the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 14 days before taking effect.
